Know Your Rights!

Your property may be condemned by the DeLa Express pipeline.

Dela Express LLC plans to acquire or condemn property for a 690-mile natural gas pipeline that will affect thousands of landowners across Texas.

Kelley PLLC is committed to helping you navigate the condemnation process and assert your rights as a property owner.

You may feel pressured by Dela Express LLC or it's agents!

We recommend consulting an experienced landowner condemnation attorney before signing anything.

Federal law authorizes Dela Express LLC to "take" or condemn property using "eminent domain". In this condemnation process, however, you have rights, including the right to fair compensation for your property.

You may have questions, such as:

  • How much am I going to get paid?
  • When will I get paid?
  • Can I negotiate with Dela Express LLC?
  • How long does the condemnation process take?
  • How does Dela Express LLC determine what my property is worth?
  • How will the condemnation affect my business or the use of my land?
  • Should I allow the Right of Way Agent to enter my property for surveys?
  • Does the Right of Way Agent work for me or Dela Express LLC?
  • Do I have to sign the Right of Way Agent's forms?
  • How long do I have to respond to the Right of Way Agent?
  • Will Dela Express LLC sue me or my family if I don't respond?

Survey Access and Right of Entry

Currently, DeLa Express and their agents are mailing questionnaires and right of entry forms to property owners along the proposed pipeline route.

It is important to know that you are not legally required to sign or complete their forms!

When it comes to surveys, we recommend granting limited and controlled access. Some factors you should consider include:

  1. Timing: The pipeline company should give advanced notice of entry and should be limited to the time needed to conduct their activities.
  2. Access: Survey access should be restricted to specific areas and entry should be restricted to predefined access points.
  3. Activities: Carefully define the types of survey activities that are allowed and require the company to leave the property in good condition.

Right of entry agreements can be complex, we recommend consulting an experienced landowner condemnation attorney before signing ANYTHING.
